About Administrative Law

Administrative law matters often involve decisions made by government bodies, boards, correctional institutions, tribunals, or other public authorities. These decisions can have serious consequences for a person’s liberty, safety, dignity, access to services, or ability to move forward with their life.

Administrative issues can arise in many different contexts such as prison decisions, parole hearings, disciplinary processes, institutional placements, or the denial or withdraw of services of benefits. 

How PATH Can Help

PATH assists with select administrative law matters that fall within our mandate, particularly where decisions affect people who are incarcerated, criminalized, or otherwise facing systemic barriers to justice. 

Depending on the issue, we may help clients understand their legal options, prepare written submissions, request reconsideration, pursue judicail review, or challenge unfair or unlawful decision-making.

Our work is client-centred, trauma-informed, and grounded in an understanding that legal problems to not happen in isolation. We take the time to listen, explain your options, and stand alongside you as you navigate the process.

Administrative Law Services

Below are examples of administrative law services PATH may provide. Our ability to assist depends on the nature of the issue, urgency, available resources, and whether the matter falls within PATH's mandate.

CHARTER LITIGATION

Charter litigation challenges laws, policies, decisions, or state actions that may violate rights protected by the Canadian Charter of Rights and Freedoms.

SECTION 161 ORDER VARIATIONS

Section 161 order variation applications ask a court to review and potentially change restrictions that are no longer workable, necessary, or appropriate.

HUMAN RIGHTS COMPLAINTS

Human rights complaints address discrimination, harassment, or unequal treatment connected to protected characteristics such as race, disability, sex, gender identity, Indigenous identity, family status, or religion.

HABEAS CORPUS

Habeas corpus applications ask a court to review whether a person’s detention, prison placement, or restrictive conditions unlawfully deprive them of liberty.

INTERVENOR APPLICATIONS

Intervenor applications allow PATH to seek permission to participate in court cases where we can offer a distinct public-interest perspective on issues connected to our mandate.

PAROLE APPEALS

Parole appeals ask the Parole Board of Canada’s Appeal Division to review certain parole-related decisions for legal, factual, or procedural errors.

JUDICIAL REVIEW

Judicial review applications ask a court to review whether an administrative decision was lawful, reasonable, procedurally fair, and consistent with the decision-maker’s obligations.

POLICE COMPLAINTS

Police complaints provide a process for raising concerns about police conduct, including excessive force, discrimination, harassment, unlawful arrest, or failure to investigate.

PAROLE ASSISTANCE

Parole assistance supports people preparing for parole hearings, release planning, written submissions, and other parole-related processes.
