JUDICIAL REVIEW

Challenging decisions. Protecting fairness.

A judicial review application is a court process used to challenge a decision made by a government body, tribunal, board, prison authority, or other administrative decision-maker. Judicial review is not usually a full re-hearing of the original issue. Instead, the court reviews whether the decision was lawful, reasonable, procedurally fair, and consistent with the decision-maker’s legal obligations.

PATH assists with judicial review matters that fall within our mandate, including decisions involving prisons, parole, administrative bodies, and state decision-making that affects liberty, dignity, equality, or access to justice. We help clients assess the decision, identify possible grounds for review, and prepare court materials where appropriate.

How We Can Help

PATH may be able to assist with:

  • Reviewing administrative decisions for legal or procedural errors

  • Assessing whether judicial review may be available

  • Preparing applications for judicial review

  • Drafting written submissions about fairness, reasonableness, jurisdiction, or Charter-related concerns

  • Seeking remedies such as quashing a decision or requiring reconsideration

  • Summary advice for individuals self-representing
