About Charter Litigation

The Charter of Rights and Freedoms protects everyone in Canada from unjust government action. It guarantees rights such as life, liberty, security of the person, equality, and protection from cruel and unusual treatment.

Charter litigation holds governments and institutions accountable when their laws, policies, or practices violate these rights, especially for people who are incarcerated, marginalized, or facing systemic discrimination.

How PATH Can Help

PATH brings Charter-based legal arguments and defends the rights of people whose rights, liberties and dignity have been denied. We take on cases that create meaningful change—not just for our clients, but for others facing similar harms. 

We may help clients understand their rights, assess potential Charter claims, gather evidence, prepare legal arguments, and represent clients in court from trial through appeal.

CHARTER LITIGATION

Charter litigation challenges laws, policies, decisions, or state actions that may violate rights protected by the Canadian Charter of Rights and Freedoms.

JUDICIAL REVIEW

Judicial review applications ask a court to review whether an administrative decision was lawful, reasonable, procedurally fair, and consistent with the decision-maker’s obligations.

INTERVENOR APPLICATIONS

Intervenor applications allow PATH to seek permission to participate in court cases where we can offer a distinct public-interest perspective on issues connected to our mandate.

SYSTEMIC NEGLIGENCE LITIGATION

Systemic negligence litigation addresses harm caused by institutional failures, unsafe practices, neglect, or repeated patterns of conduct.

HABEAS CORPUS

Habeas corpus applications ask a court to review whether a person’s detention, prison placement, or restrictive conditions unlawfully deprive them of liberty.
