Civil litigation involves taking legal action in court to address harm caused by individuals, corporations, institutions, or government bodies. These cases can help people seek justice, obtain compensation, and push for safer, more accountable systems.

Civil claims may arise from misconduct such as assault, discrimination, negligence, privacy violations, technology-facilitated violence, or other breaches of rights.

How PATH Can Help

PATH assists with select civil litigation matters that fall within our mandate, particularly where the harm is connected to incarceration, criminalization, institutional settings, technology-facilitated violence, sexual assault, or systemic inequality.

Civil Litigation Services

Below are examples of the civil litigation services PATH may provide. Our ability to assist depends on the nature of the issue, urgency, available resources, and whether the matter falls within PATH's mandate.

CHARTER LITIGATION

Charter litigation challenges laws, policies, decisions, or state actions that may violate rights protected by the Canadian Charter of Rights and Freedoms.

SEXUAL ASSAULT LITIGATION

Sexual assault litigation may allow survivors to seek accountability, compensation, or other remedies through the civil legal system, separate from the criminal process.

SYSTEMIC NEGLIGENCE LITIGATION

Systemic negligence litigation addresses harm caused by institutional failures, unsafe practices, neglect, or repeated patterns of conduct.

TECH-FACILITATED VIOLENCE

Technology-facilitated violence matters involve harm carried out or amplified through digital tools, including cyber-bullying and the non-consensual sharing of intimate images.

Class actions allow one or more representative plaintiffs to bring a lawsuit on behalf of a larger group of people who experienced similar harm.
