About Prison Law & Advocacy

Prison law focuses on the rights of people in custody and the rules and policies that govern correctional institutions and parole. These laws exist to protect people from abuse, ensure basic standards of treatment, and uphold the Charter rights that do not end at the prison gate.

Issues can arise in everyday circumstances from access to services, disciplinary matters, placement decisions, use of force, sentence navigation, and parole.

How PATH Can Help

PATH assists with select prison law matters that fall within our mandate, particularly where conditions or decisions affect safety, dignity, liberty, or meaningful access to justice.

We may help clients understand their rights, resolve issues inside the institution, challenge unfair or unlawful decisions, file grievances, represent clients in disciplinary hearings, act as an assistant in parole hearings, appeal parole decisions, or bring legal challenges when necessary. 

Our work is client-centred, trauma-informed, and grounded in an understanding that legal problems to not happen in isolation and that incarceration itself creates barriers. We take the time to listen, explain your options, and stand alongside you as you navigate the process.

Prison Law & Advocacy Services

Below are examples of the prison law and advocacy services PATH may provide. Our ability to assist depends on the nature of the issue, urgency, available resources, and whether the matter falls within PATH's mandate. 

CHARTER LITIGATION

Charter litigation challenges laws, policies, decisions, or state actions that may violate rights protected by the Canadian Charter of Rights and Freedoms.

PAROLE APPEALS

Parole appeals ask the Parole Board of Canada’s Appeal Division to review certain parole-related decisions for legal, factual, or procedural errors.

HABEAS CORPUS

Habeas corpus applications ask a court to review whether a person’s detention, prison placement, or restrictive conditions unlawfully deprive them of liberty.

INSTITUTIONAL DISCIPLINARY HEARINGS

Institutional disciplinary hearings address alleged rule violations in custody that can affect privileges, conditions, security classification, parole, or release planning.

SYSTEMIC NEGLIGENCE LITIGATION

Systemic negligence litigation addresses harm caused by institutional failures, unsafe practices, neglect, or repeated patterns of conduct.

JUDICIAL REVIEW

Judicial review applications ask a court to review whether an administrative decision was lawful, reasonable, procedurally fair, and consistent with the decision-maker’s obligations.

PAROLE ASSISTANCE

Parole assistance supports people preparing for parole hearings, release planning, written submissions, and other parole-related processes.

PRISON ADVOCACY

Prison advocacy addresses serious concerns about conditions of confinement, health care, safety, isolation, programming, family contact, discrimination, or other issues affecting people in custody.
