Legal expertise is not required to apply for parole; however, the procedure is complex and can be difficult to navigate alone. PATH offers legal services to those seeking parole and will advocate against challenges to obtaining parole including systemic racism. Our legal services are also available for those challenging a decision to deny or revoke parole.
How do I challenge the Parole Board’s decision to deny or revoke my parole?
When parole is denied or revoked, you must wait at least one year before re-applying. However, you also have two months to challenge the decision to deny or revoke your parole. Challenges go to the Parole Board of Canada’s Internal Appeals Division. The Appeals Division will either agree with the decision to deny or revoke parole. If they agree the case may go to court for a judicial review. If the Appeals Division disagrees that parole should be denied/revoked, they will have the Parole Board of Canada render a new decision.
