What is settlement?

The media usually shows lawyers working in the courtroom, but in reality, most legal work is completed outside of the courtroom. Before going to trial, lawyers must exchange and examine evidence to determine the strength of each side’s arguments. However, a trial may never come. In fact, frequently lawsuits end after a settlement has been reached.  


So, what does it mean to settle a lawsuit? After evidence has been examined and exchanged, lawyers engage in negotiations. This means that the lawyers get together to discuss and propose fair offers to resolve the issues and find a solution that everyone can agree to.

The Process

FILE A LAWSUIT WITH THE COURT

After a lawyer has been hired, they will submit the appropriate documents to the court and to the opposing party.

EXCHANGE AND EXAMINE EVIDENCE

Once all initial documents have been filed, both parties must exchange relevant evidence with each other. 

SETTLEMENT NEGOTIATION

After collection and examination of all relevant evidence, the parties will attempt to negotiate a settlement.

TRIAL

If no settlement can be reached or settlement is undesirable, the two parties will go to trial.

REMEDY/OUTCOME AT TRIAL

At trial, each party will present evidence and arguments to the judge who will make the final determination as to whether serious harm was suffered. Subsequently, they will order any appropriate remedies.

  1. If you win the trial, the judge may order financial compensation or other remedies requested. 

  2. Through settlement, there are many creative remedies that can be agreed to such as,

    2. Apology or form of accountability 

    3. Restorative justice circle practices
